Robert Trusiak represents hospital and physician clients on regulatory,
statutory, and enforcement issues. He separately provides complete health care consulting services for physician providers, hospitals, research labs, skilled nursing facilities, pharmaceutical companies, durable medical equipment entities and manufacturers of medical marijuana. Mr. Trusiak’s public clients include Catholic Charities, Diocese of Rochester, NY, as Chief Compliance Officer and BryLin Behavioral Health Systems, Buffalo, NY, as Vice President, General Counsel and Chief Compliance Officer.

Robert also counsels clients on a number of state and federal health care regulatory matters, including health care reform, fraud and abuse, the Stark Law, Privacy Law, and health care compliance issues. Robert is an experienced compliance officer who, as an independent reviewer, addresses any deficiencies in the compliance program. He is a counselor and confidant of hospital CEOs, Board members, and physician leaders across the country.

Complying with the Privacy Rule of the Health Information Portability & Accountability Act of 1996 (HIPAA) could be a major challenge for an organization. Mr. Trusiak has the required expertise to serve as an organization’s Designated Privacy Officer (DPO) and oversee the development, implementation, maintenance of, and adherence to privacy policies and procedures regarding the safe use and handling of protected health information (PHI) in compliance with federal and state HIPAA regulation. He has experience and detailed knowledge of federal and state privacy laws/regulations, and has prior experience in dealing with privacy issues, data breaches, and HIPAA risk assessment requirements. An organization will realize better risk protection with a well informed and experienced DPO with the added experience of negotiating HIPAA settlements with the Office of Civil Rights.

Mr. Trusiak also is an Adjunct Professor, University at Buffalo, SUNY, teaching a graduate level course entitled Health Care Fraud and Abuse.

Previously, Robert served as Chief Compliance Officer at a large health care provider, caring for over one million patients annually, where he managed the internal Compliance team, litigation teams of outside counsel, litigated administrative and contractual actions, ensured regulatory and statutory compliance, including Medicare Secondary Payor and HIPAA, and resolved matters involving accrediting and enforcement entities as well as individual matters.

Robert also served as Assistant United States Attorney, where he prosecuted civil and criminal cases on behalf of the United States of America involving health care fraud, Department of Defense fraud, HUD fraud, grant fraud, VA fraud, ERISA violations, Tax fraud, Securities fraud, Customs violations, USDA violations, and all forms of procurement fraud.

Furthermore, Robert has received numerous awards including the 2011 HHS OIG Commendation for Superior Performance and the 2000 FBI Director’s Award. Robert regularly speaks across the country on topics dealing with health care issues and has authored a variety of articles on health law topics.

Robert received his Bachelor of Science degree in Business Economics from the University of Akron and his Juris Doctorate degree from the Cleveland-Marshall College of Law.
